WARNING: The following policy (“Policy”) outlines the rules for accessing the computer services, systems, networks, and services (collectively, the “System”) of SBA Communications Corporation and its affiliates (the “Company”). This is a private System for use by authorized users only and solely for designated purposes. By clicking “I Accept”, or by accessing or using the System, you signify that you have read, understand, and agree to comply with this Policy and its terms and acknowledge that your activities on the System may be logged and monitored for security and compliance purposes, in accordance with all applicable legislation, ordinances, regulations, and by-laws. Any personal information processed during monitoring will be handled in accordance with applicable data privacy legislation. In addition, the user agrees not to extract, use, or share the System’s information related to personal data for purposes other than those intended by the Company and will observe and comply with all applicable law (including the relevant data privacy legislation). Violation of this Policy may result in formal warnings, the termination, suspension, or restriction of access to the Company System.

You are prohibited from accessing or using the System for any unauthorized use or unlawful, harmful, or disruptive activities, including but not limited to: (1) violating any applicable local, state, national, or international laws or regulations, treaties, court orders, or administrative rule; (2) engaging in any fraudulent activities such as identity theft or financial scams or to falsely impersonate another person through any means; (3) gaining unauthorized access to networks or accounts or to attempt to penetrate another entity’s network system on an unauthorized basis; (4) distributing malware, viruses, or any other harmful software; (5) interfering with the security or availability of the System or the ability of other users to access or use the System; (6) overloading, disrupting, or attacking the System, any networks, servers or other infrastructure; (7) using automated tools in a way that degrade the System’s quality; (8) hosting, promoting, transmitting, or distributing content that could harm the Company’s reputation (with the exception of content protected by applicable law); (9) accessing any site, or posting, transmitting, or distributing material, that is harassing, coercive, indecent, intimidating, illegal and discriminatory, malicious, fraudulent, libelous, violent, defamatory, obscene, hateful or encouraging of any illegal activity; (10) engaging in activities that promote violence, illegal discrimination, or other illegal conduct; (11) intercepting, interfering, or redirecting another person’s e-mail or other transmissions; (12) sending spam, phishing emails, or any other unsolicited communications or data; (13) using, distributing, or reproducing copyrighted or trademarked material without authorization, or otherwise violating, infringing, or misappropriating intellectual property, publicity, privacy, or other proprietary or protected rights; or (14) violating any export control laws, or downloading or using the System in destinations that are otherwise controlled or embargoed under U.S. and applicable local legislation. Violations of this Policy or any other unauthorized access or use of the System is strictly prohibited and subject to the possibility of the following against you: suspension or termination of your access to the System, disciplinary action (including formal written warning and/or termination), civil action for damages, and/or criminal prosecution. Any trespass to this System shall be seen as criminal trespass and will be prosecuted to the fullest extent of the applicable laws.

Company reserves the right, without prior notice, to discontinue System access at any time. Company may monitor all activity over the System, including sites visited, time spent on any site, and information transmitted or received. All use of this System by you beyond this point constitutes your express acknowledgement that you are not entitled to any expectation of privacy while using the System and that you consent to being monitored at all times while using the System without further notice, including but not limited to all of your activities being observed, recorded, and/or subject to automated logging, in accordance with relevant data privacy legislation. Any personal information processed during monitoring will be handled lawfully and only for legitimate business purposes. If monitoring reveals possible evidence of your violation of any criminal law and personal data protection law this evidence and any other related information, including identification information about you, may be provided to law enforcement officials at the Company’s sole discretion and without any notice to you. Company reserves the right to update this Policy from time to time without prior notice, for which you hereby give your consent, in compliance with relevant data privacy legislation. You are responsible for reviewing any updates made and agree to comply with such updates upon clicking to accept the updated Policy or by continuing to access or use the System following such updates. Your continued use of the System constitutes acceptance of the revised Policy.

COMPANY PROVIDES THE SYSTEM ON AN “AS IS” AND “AS-AVAILABLE” BASIS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, COMPANY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING UNINTERRUPTED OR ERROR-FREE USE OR THE QUALITY, FUNCTIONALITY, OR SECURITY OF THE SYSTEM AND WILL NOT BE RESPONSIBLE FOR ANY LOSS (INCLUDING LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL), DAMAGE, OR COST RELATING TO A USER’S ACCESS OR USE, OR INABILITY TO ACCESS OR USE, THE SYSTEM. USER HEREBY RELEASES COMPANY FROM ANY CLAIMS DUE TO ANY SUCH LOSSES.

If you do not agree to all of the above, you must immediately disconnect from the System and cease and desist from any further access or use.
